Whether the Debt is Owed or Not: Unlawful Collection Practices Checklist

  1. Calls after 9:00 p.m. or before 8:00 a.m., without your consent
  2. Use of foul or obscene language
  3. Misleading or exaggerated collection letters
  4. Continued collection efforts, after you have written for them to stop
  5. Collect telephone calls, without stating the purpose of the call
  6. Contact at work, if prohibited by your employer
  7. Threats or use of force or violence
  8. Collector's contact with anyone other than yourself about your debt
  9. Falsely accused of criminal activity or that you will be arrested
  10. Received papers which appear to be court papers
  11. Misrepresented amount of debt or added unauthorized charges
  12. Threat of a lawsuit, or an action that the collector does not intend to take
  13. Threat of wage garnishment
